Welcome to desforgesvineyards.com. These Terms and Conditions ("Terms") govern your access to and use of our website and any purchases you make through the Site. By using the Site or placing an order, you agree to be bound by these Terms.
Please read them carefully before using the Site or making a purchase.
1. Eligibility
By using the Site and placing any order, you represent and warrant that:
You are at least 21 years of age
The purchase of alcohol is legal in your state and locality
You will not resell, barter, or otherwise transfer alcohol purchased through this Site in violation of any applicable law
We reserve the right to refuse service to anyone who cannot verify their age or who resides in a state where we cannot legally ship wine.
2. Wine Sales and Orders
Powered by Vinoshipper
All wine purchases made through this Site are processed and fulfilled by Vinoshipper, a licensed wine marketplace and fulfillment platform. By completing a purchase, you are entering into a transaction facilitated by Vinoshipper and you agree to be bound by Vinoshipper's Terms of Service, which are available at vinoshipper.com.
Desforges Vineyards retains ownership of all wines listed on the Site. Vinoshipper acts as an authorized agent for the purpose of completing the sale and ensuring compliance with applicable alcohol laws.
Pricing
All prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes and shipping fees will be calculated and displayed at checkout.
Order Acceptance
Placing an order does not constitute a guaranteed contract of sale. We reserve the right to refuse or cancel any order for any reason, including product unavailability, pricing errors, or compliance concerns. If your order is cancelled after payment has been processed, you will receive a full refund.
3. Shipping and Delivery
We ship to states where Vinoshipper is permitted to deliver wine on our behalf. Not all states allow direct-to-consumer wine shipments. If your state is not supported, we will notify you at checkout or contact you directly.
All deliveries require an adult signature (21+) at the time of delivery. Carriers will not leave wine unattended. It is your responsibility to ensure someone of legal drinking age is available to receive the shipment.
Desforges Vineyards is not responsible for delays caused by the carrier, extreme weather, or circumstances outside our control. Risk of loss passes to you upon delivery.
4. Returns and Refunds
All wine sales are final. Due to the perishable nature of wine and state alcohol regulations, we cannot accept returns of opened or consumed wine.
If your order arrives damaged or if there is a quality issue, please contact us within 7 days of delivery at info@desforgesvineyards.com with photos of the damaged product and packaging. We will work with you to resolve the issue, which may include replacement or credit at our discretion.
Shipping fees are non-refundable unless the error is ours.
5. Wine Club Membership
By enrolling in a Desforges Vineyards wine club membership, you agree to the specific terms communicated at the time of enrollment, including shipment frequency, minimum commitment, and cancellation policies. Membership details are managed through Vinoshipper.
You may cancel your membership at any time prior to the processing of your next scheduled shipment by contacting info@desforgesvineyards.com. Cancellations received after a shipment has been processed cannot be refunded.
6. Intellectual Property
All content on this Site, including text, photographs, graphics, logos, and design, is the property of Desforges Vineyards and is protected by applicable copyright and intellectual property laws. You may not reproduce, redistribute, or use any content from this Site without our prior written permission.
7. Disclaimer of Warranties
This Site and its content are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. We make no representations about the accuracy or completeness of any information on the Site.
8. Limitation of Liability
To the fullest extent permitted by law, Desforges Vineyards and its owners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any products purchased through the Site. Our total liability for any claim shall not exceed the amount you paid for the order in question.
9. Alcohol Compliance
The purchase, shipment, and consumption of wine is regulated by state and local laws. You are solely responsible for ensuring that your purchase and receipt of wine is lawful in your jurisdiction. We will not ship to states or localities where such shipment is prohibited.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts of Sonoma County, California.
11. Changes to These Terms
We may update these Terms at any time by posting a revised version on this page with an updated effective date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
